19.1不可抗力的定义

在本条中,“不可抗力”系指某种异常的事件或情况:

(a) 一方无法控制的;

(b) 该方在签订合同前,不能对之进行合理准备的;

(c) 发生后,该方不能合理避免或克服的;及

(d) 不能主要归因于他方的。

只要满足上述(a)至(d)项条件,不可抗力可以包括但不限于下列各种异常事件或情况:

(i) 战争、敌对行动(不论宣战与否)、入侵、外敌行为;

(ii) 判乱、恐怖主义、革命、暴动、军事政变或篡夺政权、或内战;

(iii) 承包商人员和承包商及其分包商其他雇员以外的人员的骚动、喧闹、混乱、罢工或停工;

(iv) 战争军火、爆炸物资、电离辐射或放射性污染,但可能因承包商使用此类军火、炸药、辐射或放射性引起的除外;

(v) 自然灾害,如地震、飓风、台风、或火山活动。

In this Clause, Force Majeure means an exceptional event or circumstance:

(a) which is beyond a Partys control,

(b) which such Party could not reasonably have provided against before entering into the Contract.

(c) Which, having arisen, such Party could not reasonably have avoided or overcome, and

(d) which is not substantially attributable to the other Party.

Force Majeure may include, but is not limited to, exceptional events or circumstances of the kind listed below, so long as conditions (a) to (d) above are satisfied:

(i) war, hostilities (whether war be declared or not), invasion, act of foreign enemies,

(ii) rebellion, terrorism, revolution, insurrection, military or usurped power, or civil war,

(iii) riot, commotion, disorder, strike or lockout by persons other than the Contractors Personnel and other employees of the Contractor and Subcontractors,

(iv) munitions of war, explosive materials, ionising radiation or contamination by radio-activity, except as may be attributable to the Contractors use of such munitions, explosives, radiation or radio-activity, and

(v) natural catastrophes such as earthquake, hurricane, typhoon or volcanic activity.
