近五年来我国档案法规研究综述

【摘　要】本文对近五年来我国档案法规的研究成果、研究范围和主题分布、主要内容与观点进行了梳理与分析。认为五年来我国档案法规的研究成果主要体现在颁布档案法规、出版档案法规学著作及发表档案法规研究论文方面;研究范围涉及十二个方面，包括档案立法及档案法规体系、档案法制建设、档案法律责任与档案法律关系、档案行政执法及执法监督检查、档案法律与知识产权等权益、档案法律与电子文件、《中华人民共和国档案法》的研究及修改、地方档案法规、外国档案法规及中外档案法规的比较、档案法律对档案工作的指导、非国有档案相关法规、信息化档案立法;主要研究热点是如何完善档案法规体系、怎样处理档案工作中各种相关权利、对《中华人民共和国档案法》的修改建议、档案行政执法及执法监督检查、档案法制建设。

An Overviewon the Archival Laws and Regulations Studies in the Last Five Years in China

【Abstract】This paper cards and analyzes the research results，the research scope，the subjects distribution and main contents of archival legislation in the past five years.The authors consider that the main research achievements are archival legislation，the works publication and paper publishing;The paper makes a summary of archival legislation and legal system，legal construction，legal obligation and nexus，administrative law enforcement and supervision，archival laws and Intellectual property，archival laws and electronic records，the research and modification of Archives Law of the Peoples Republic of China，local archival regulations，the archival laws and regulations of the foreign countries，the compare of Sino-foreign archival laws and regulations，the guidance of archival laws to archival work practices，non-state-owned archives laws，informationalized archives legislation; the research hot spots are how to improve the archival laws system，how to handle the related rights in archival work practices，the modifacation suggestions of Archives Law of the Peoples Republic of China，administrative law enforcement and supervision，archival the compare of the modify of archival regulation，administrative enforcement and supervision of archival regulation，archives legal construction.

梳理与总结近年来我国档案法规研究状况，是为了了解我国档案法规方面有哪些新的进展、有哪些方面还需要改进、有哪些亟待明确和解决的问题，以促进我国档案法规研究与档案法制建设的发展。由此，我们对近五年来档案法规专门著作、教材和档案事业类核心刊物中关于档案法规的研究成果进行了调研和统计分析，并对其中一些重要问题进行了综述和分析。
