空运单的装运日期

【摘要】：受益人认为：空运单有一个专项批注的发运日7月5日，那是装运日期，从此至汇票日期7月15日仅10天，没有超过21天，不是延迟交单的不符点。过去，根据UCP500的规定，ICC银行委员会认为：即使空运单有了专项批注的发运日期，因为信用证没有要求批注实际发运日，故仍然要以出单日作为装运日，延迟交单的不符点可以成立。

三、空运单的装运日期

UCP600第二十三条a款第iii项，对空运单的装运日期的表述如下：

UCP600 Article 23 Air Transport Document（国际商会中国国家委员会，2007，p56～58）

iii. indicate the date of issuance. This date will be deemed to be the date of shipment unless the air transport document contains a specific notation of the actual date of shipment， in which case the date stated in the notation will be deemed to be the date of shipment.

Any other information appearing on the air transport document relative to the flight number and date will not be considered in determining the date of shipment.

UCP600第二十三条a款第iii项的译文如下：

表明出具日期。该日期将被视为发运日期，除非空运单据载有专门批注注明实际发运日期，此情况下批注中的日期将被视为发运日期。

空运单据中与其他航班号和航班日期相关的信息将不被用来确定发运日期。

案例3.2　信用证没有要求实际发运日期⁽⁵⁾

空运单情况：Issuance date： June 20， 1994.

Flight No.127

Date of dispatch： July 5， 1994

汇票表示：Date of Draft： July 15， 1994

开证行认为：信用证没有要求实际发运日期，空运单签发日期视为装运日期，故6月20日作为装运日，从此直到汇票日期（即单据交到银行日）共25天，超过21天，开证行认为这是延迟交单的不符点而拒付。
